Kanye West is facing a lawsuit from singer-songwriter Alice Merton, who claims he sampled her 2022 song Blindside in his track Gun to My Head, despite her refusal due to his antisemitic and racist comments.
The lawsuit, filed in California federal court, alleges that West used the sample after Merton denied his request in February 2024. She was “shocked and humiliated” when West previewed the track at a December 2023 event and later released it in August 2024 as part of Vultures 2. Merton, who has Jewish family ties, stated she did not want to be associated with West due to his controversial remarks.
The suit also mentions that Merton faced threats from West’s fans after the song was excluded from the initial tracklist, leading her to stop performing Blindside live due to safety concerns. BMG sent a cease-and-desist letter after the release, which was reportedly ignored.
West has not yet commented on the lawsuit.
Merton joins other artists who have sued West for copyright infringement, including Ozzy Osbourne and the estate of Donna Summer.
